Overview
The Health Insurance Portability and Accountability Act (HIPAA) of 1996 is one of the most far-reaching and important pieces of health care legislation ever passed by Congress. It includes many new government mandates aimed at ensuring patient privacy, confidentiality, and security. It also includes national standards for electronic transactions between payors and providers, and requires all providers and payors to comply with these standards.
While it is generally agreed that HIPAA is a good thing, the actual implementation of HIPAA promises to be one of the most wrenching challenges in the history of the physician sector.
By April 14, 2003, all physicians were required to be fully compliant with HIPAA's Privacy policies. By October 16, 2003, all physicians and payors were required to be compliant with HIPAA's new national Transactions standards. The final Security regulations are expected soon, and compliance with them will probably be required by the end of 2005.
Many physicians, once they begin to grasp the full extent of what HIPAA requires of them, will find themselves wondering how they will manage to comply with the law's mandates.
